Who Needs an Asbestos Inspection?

Are Homeowners and Commercial property owners who are planning to remodel, renovate, repair or demolish their property required by NY State to have their properties inspected for asbestos before commencing with the work?

YES, in many cases. On January 11, 2006, the New York State Department of Labor adopted amendments to the states asbestos regulations, known as Industrial Code Rule (ICR) 56 to conform it to federal asbestos regulations and to better align New York”s asbestos requirements with those of OSHA and EPA. (For more info. on the regulations: click here.)

When do these rules go into effect?

The amendments became effective and were enforced on September 5, 2006. Click here for more information.

Why did these new rules come into effect?

These rules were recently amended by NY State (DOL) because the State recognizes that there is the potential to people being exposed to asbestos and asbestos containing materials (ACM) during the renovation, remodeling, demolition or repair of residential and commercial structures.

Asbestos is a known carcinogen and exposure to asbestos has been linked to mesotheilioma and other forms of cancer.
